OFFICIAL RULES

ALOHA LIFE LETTERS MONTHLY ORIGINAL ARTWORK GIVEAWAY FOR US RESIDENTS

OFFICIAL RULES

NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN. A PURCHASE WILL NOT IMPROVE YOUR CHANCES OF WINNING. VOID WHERE PROHIBITED BY LAW.

1. No Purchase Necessary

No purchase or payment of any kind is necessary to enter or win this giveaway. A purchase or payment will not improve your chances of winning.

Active paid United States subscribers to the Aloha Life Letters monthly art print and snail mail letters club are entered automatically as a courtesy and receive one (1) entry. Anyone else may enter free by either method described in Section 5 to receive one (1) entry. Every entry, however it was submitted, goes into the same single drawing, carries the same one-entry weight, and has exactly the same chance of winning. Subscribing does not increase your odds, does not give you additional entries, and is not required to enter or win. Void where prohibited or restricted by law.

2. Sponsor

This giveaway is sponsored and administered solely by Kelly Valencia LLC, PO Box 390, Kilauea, HI 96754-0390 ("Sponsor"). Aloha Life Letters is a brand of Sponsor. Questions may be directed to aloha@alohalifeletters.com.

3. Eligibility

This giveaway is open only to legal residents of the fifty (50) United States and the District of Columbia who are eighteen (18) years of age or older at the time of entry. It is not open to entrants located outside the United States, and prizes will be shipped only to addresses within the fifty United States and the District of Columbia.

Subscribers located outside the United States, including subscribers to the International Correspondence Edition, are not eligible for this giveaway and are not entered automatically. This is a restriction under United States law, not a difference in the value of their subscription.

Sponsor, its owners and members, and their immediate family members and household members, are not eligible to enter or win. "Immediate family members" means parents, children, siblings, spouses, and their spouses. "Household members" means people who share the same residence, whether or not related. Void where prohibited or restricted by law.

4. Entry Period—each month is a separate giveaway

Each monthly giveaway is a separate, independent promotion with its own entry period, prize, and drawing. Entries do not carry over from one month to the next. To be entered in a given month's drawing, a free entry must be submitted, or a subscription payment must be received, during that month's Entry Period.

Each Entry Period begins at 12:00:01 a.m. Hawaiʻi-Aleutian Standard Time on the 15th day of a calendar month and ends at 11:59:59 p.m. Hawaiʻi-Aleutian Standard Time on the 14th day of the following calendar month.

5. How to Enter—three routes, one entry each, identical odds

There are three ways to be entered, each resulting in one (1) entry. All entries are pooled into a single drawing, and each has an equal chance of being selected.

Method A—Automatic entry for US subscribers. If you hold an active, paid United States subscription to Aloha Life Letters, and your payment for the following month's subscription has been received and not refunded or reversed as of the close of the Entry Period, you are entered automatically. You do not need to do anything. Sponsor will use the email address on your subscription account for notification. If a subscription payment is later refunded, reversed, or charged back, the associated entry is void.

Method B—Free online entry. Complete the entry form at https://www.kellyvalencia.com/monthly-giveaway during the Entry Period. You must provide your full name, a valid email address, and a complete US mailing address. No purchase or payment of any kind is required.

Method C—Free mail-in entry. Hand-print the following on a 3" × 5" card: your full name, a valid email address, and your complete US mailing address. Please write legibly. If your card is drawn, the email address you provide is the only way Sponsor can reach you. Mail the card in an envelope with proper postage to:

Kelly Valencia
Aloha Life Letters Monthly Giveaway Entry
PO Box 390
Kilauea, HI 96754-0390

Mail-in entries must be postmarked by the 14th day of the month in which the Entry Period closes and received by the 21st day of that month. Postage is the only cost of entering by mail, and no purchase or payment to Sponsor is required.

Gift subscriptions. Where a subscription has been purchased as a gift, the automatic entry belongs to the recipient—the person to whom the mailings are addressed—and not to the purchaser. A purchaser who is not themselves a subscriber may enter free under Method B or Method C.

6. An email address is required

A valid, working email address is required for every entry. Sponsor uses email as the sole method of contacting a potential winner, and cannot notify a winner or arrange shipment of the prize without one. For subscribers entered automatically under Method A, Sponsor uses the email address on the subscription account; subscribers are responsible for keeping that address current.

A free entry submitted without an email address, or with an email address that is incomplete, illegible, invalid, or non-functioning, is void and will not be entered into the drawing. Entrants are encouraged to add aloha@alohalifeletters.com to their contacts or safe-sender list so that notifications are not filtered as spam. Sponsor is not responsible for notifications that are blocked, filtered, or not received.

Providing an email address to enter this giveaway does not subscribe you to any mailing list. See Section 14.

7. Entry limit—one entry per person, however you enter

Limit one (1) entry per person and one (1) entry per household per Entry Period, counting all methods together.

A subscriber who is entered automatically under Method A and who also submits a free entry under Method B or Method C still receives a total of one (1) entry. Subscribing does not stack with a free entry, and there is no way to obtain more than one entry in a single Entry Period. If more than one entry is received for the same person or household during a single Entry Period, only one will be entered into the drawing, and the remainder will be void.

Any attempt to obtain more than the stated number of entries—including by using multiple email addresses, multiple mailing addresses, multiple identities, multiple subscriptions, or any automated, scripted, or robotic entry method—will void all of that person's entries and may result in disqualification from future giveaways at Sponsor's discretion. Holding more than one subscription does not produce more than one entry.

Entries that are illegible, incomplete, mechanically reproduced, photocopied, or altered are void. All entries become the property of Sponsor and will not be returned or acknowledged. Sponsor is not responsible for lost, late, misdirected, damaged, delayed, or postage-due mail, or for any failure, interruption, or error of the online entry form.

8. Prize

One (1) prize will be awarded per Entry Period: one (1) original work of art created by Kelly Valencia. The medium, dimensions, and subject of the artwork are selected by the artist in her sole discretion and are described on the giveaway page for the applicable Entry Period. Approximate Retail Value (ARV): between $40 and $500, depending on the work offered. Sponsor may occasionally offer a work of greater value and will state that value on the giveaway page for the applicable Entry Period; in no event will the ARV of any single prize exceed $1,999.99.

The prize will be awarded. Sponsor ships the prize to the winner at Sponsor's sole expense, with tracking, to a valid address within the fifty United States or the District of Columbia, and expects to ship during the following month's mailing cycle. The winner pays nothing to enter, claim, or receive the prize. The prize is not transferable, and no cash or other substitution is permitted, except that Sponsor reserves the right to substitute an original work of comparable value if the advertised artwork becomes unavailable for reasons beyond Sponsor's reasonable control.

If no eligible entries are received during an Entry Period, no prize will be awarded for that Entry Period, and the artwork may be offered in a subsequent Entry Period.

9. Odds of winning

The odds of winning depend on the total number of eligible entries received during the applicable Entry Period, including both automatic subscriber entries and free entries. Every eligible entry has an equal chance of being selected.

10. Winner selection

One (1) potential winner will be selected in a random drawing from among all eligible entries received during the Entry Period. Subscriber entries and free entries are pooled into a single drawing and are not distinguished in any way. The drawing will be held on or about the 22nd day of the month in which the Entry Period closes, or the next business day if that day falls on a weekend or federal holiday, and will be conducted by Sponsor, whose decisions on all matters relating to this giveaway are final and binding.

11. Winner notification, response deadline, and forfeiture

Potential winners will be notified using the email address provided at the time of entry. A potential winner must respond within seven (7) calendar days of the initial notification. Sponsor may make up to three (3) attempts to contact the potential winner. If the potential winner cannot be contacted, fails to respond within the required period, is determined to be ineligible, or fails to comply with these Official Rules, the prize will be forfeited, and an alternate potential winner may be selected by random drawing from the remaining eligible entries.

For subscribers entered automatically, the email address provided at the time of entry means the email address on the subscription account as of the close of the Entry Period. The seven (7) calendar day response period runs from the date the initial notification is sent, regardless of how many additional contact attempts Sponsor makes within that period. An alternate potential winner is subject to these same notification and response requirements. Sponsor will repeat this process as necessary until the prize has been awarded to an eligible entrant who responds and complies with these Official Rules.

To claim the prize, a confirmed winner must provide a valid shipping address within the fifty United States or the District of Columbia, and, where required under Section 13, a completed IRS Form W-9.

12. Prize limit—winning more than once

Limit one (1) prize per person and one (1) prize per household per rolling twelve (12) month period.

A person who has been confirmed as a winner may continue to enter subsequent monthly giveaways, and subscribers in that position continue to be entered automatically, but they are not eligible to win a second prize until twelve (12) months have passed from the date of the drawing in which they last won. If a person who is within that twelve-month window is selected in a drawing, that selection is void, the entry is set aside, and Sponsor will draw again from the remaining eligible entries.

This limit applies per household and per person. Only one member of a household may win a prize in any rolling twelve (12) month period.

13. Taxes

All federal, state, and local taxes on the prize are the sole responsibility of the winner. The prize is reportable as income at its fair market value regardless of whether any tax form is issued.

Where the approximate retail value of the prize meets or exceeds the IRS reporting threshold applicable in the year the prize is awarded, the winner will be required to provide a completed IRS Form W-9 before the prize is shipped, and Sponsor will issue an IRS Form 1099-MISC for that tax year. Failure to return a required Form W-9 within ten (10) calendar days of Sponsor's request will result in forfeiture of the prize and selection of an alternate potential winner under Section 11.

14. Entrant information, privacy, and how long data is kept

Sponsor collects entrants' names, email addresses, and mailing addresses solely to verify eligibility, administer the drawing, notify the potential winner, and ship the prize. For subscribers entered automatically, Sponsor uses the name, email address, and mailing address already on the subscription account and does not collect any additional information. Sponsor does not sell, rent, or trade entrant information, and does not share it with third parties except as necessary to ship the prize or as required by law.

Entering does not sign you up for anything. Free entrants are added to Sponsor's email list only if they separately and affirmatively opt in. The opt-in is optional, is not a condition of entry, and has no effect on your chance of winning. Mail-in entrants are not added to any list unless they write "YES—newsletter" on their entry card or sign up for the newsletter on the website.

Sponsor retains information as follows. Free-entry information from entrants who do not win is deleted within ninety (90) days after the drawing for the Entry Period in which they entered. Subscriber account information is governed by Sponsor's ordinary subscription and privacy terms rather than by this giveaway, and no separate giveaway record of a non-winning subscriber entry is retained beyond ninety (90) days. Winner records—name, state, prize awarded, approximate retail value, drawing date, and shipping confirmation—are retained for a minimum of twelve (12) months in order to administer the prize limit in Section 12, and where a Form 1099-MISC was issued, for as long as required for tax recordkeeping purposes.

Sponsor's Privacy Policy at https://www.kellyvalencia.com/privacy-policy applies to information collected through this giveaway.

15. General conditions

By entering, or by being entered automatically as a subscriber, each entrant affirms that they meet the eligibility requirements in Section 3, and agrees to be bound by these Official Rules and by Sponsor's decisions, which are final and binding in all respects. Sponsor reserves the right to disqualify any person who tampers with the entry process, submits entries in excess of the stated limit, provides false information, or otherwise acts in violation of these Official Rules.

Sponsor reserves the right to cancel, suspend, or modify this giveaway if fraud, technical failure, or any other factor beyond Sponsor's reasonable control impairs its integrity, and in such an event to award the prize by random drawing from among all eligible entries received prior to the impairing event. These Official Rules will not be changed after an Entry Period has begun.

16. Release and limitation of liability

By participating, entrants release and hold harmless Sponsor and its owners, members, employees, and agents from any and all liability for any loss, harm, damage, injury, cost, or expense arising out of participation in this giveaway or out of the acceptance, possession, or use of the prize. Sponsor's responsibility for the prize ends upon delivery of the prize to the shipping carrier. Sponsor is not responsible for any prize that is lost, delayed, damaged, stolen, or misdelivered in transit and is not obligated to replace it, but may offer a replacement work of comparable value in its sole discretion.

17. Publicity

Except where prohibited by law, acceptance of the prize constitutes permission for Sponsor to use the winner's first name and state of residence in connection with announcing and promoting this giveaway, without further compensation, notice, or approval. Sponsor will not publish a winner's full name, street address, email address, or photograph without that person's separate written permission.

18. Winner list

Sponsor will post the winner's first name and state of residence on the giveaway page at https://www.kellyvalencia.com/monthly-giveaway following confirmation. For a written list of winners, send a self-addressed stamped envelope to Kelly Valencia, Aloha Life Letters Winner List, PO Box 390, Kilauea, HI 96754-0390, to be received no later than six (6) months after the applicable drawing date.

19. Platform disclaimer

This giveaway is in no way sponsored, endorsed, or administered by, or associated with, Instagram, Facebook, Meta Platforms, Inc., TikTok, Pinterest, or any other platform on which it may be mentioned or advertised. Entrants completely release each such platform from any and all liability in connection with this giveaway. Information submitted with an entry is provided to Sponsor and not to any platform. Any questions, comments, or complaints regarding this giveaway must be directed to Sponsor and not to any platform.

20. Governing law

This giveaway and these Official Rules are governed by the laws of the State of Michigan, the state in which Sponsor is organized, without regard to conflict of law principles. Any dispute arising out of or relating to this giveaway shall be resolved in the state or federal courts located in the State of Michigan, and by entering, entrants consent to the jurisdiction of those courts. Nothing in this Section limits any right or remedy an entrant may have under the consumer protection laws of their own state.

21. Contact

Questions about this giveaway may be directed to aloha@alohalifeletters.com.

Appendix—your operating manual

None of this goes on your website.

What changed in v5

• All URLs now point at kellyvalencia.com; alohalifeletters.com 301-redirects there

• Mail-in and winner-list addresses print "Kelly Valencia"—add that exact name to the PO Box before publishing

• Sponsor remains Kelly Valencia LLC (Michigan)—Aloha Life Letters LLC does not exist yet and cannot sponsor anything

• "Aloha Life Letters" appears as a brand, never with "LLC" attached, until the Hawaiʻi filing completes

• Section 20 governing law and forum moved to Michigan, with a sentence preserving entrants' own state consumer rights

• Method C and Section 18 addresses read "Kelly Valencia", with "Aloha Life Letters Monthly Giveaway Entry" as the attention line

• Section 8 gained a zero-entries clause—at your current scale a month with no eligible entries is realistic, and Hawaiʻi requires that an unawarded prize be disclosed in advance

What to swap when Hawaiʻi completes

When Aloha Life Letters LLC is approved, publish a revised version between Entry Periods—before the 15th. Five changes, and nothing else moves:

Where Now After approval
Policy title Aloha Life Letters Aloha Life Letters LLC
Section 2 Kelly Valencia LLC … Aloha Life Letters is a brand of Sponsor Aloha Life Letters LLC (drop the brand sentence)
Section 5, Method C Kelly Valencia Aloha Life Letters LLC
Section 18 Kelly Valencia, Aloha Life Letters Winner List Aloha Life Letters LLC, Winner List
Section 20 Michigan Hawaiʻi

Add Aloha Life Letters LLC to the PO Box as a third authorized name at the same time, and keep the earlier names on it so mail addressed either way still arrives. Then update the site, terms, and invoices to match—that is the moment "LLC" becomes safe to write.

The rule you are now living under: equal dignity

Automatic subscriber entry is legal and standard—Hawaiʻi's own HRS § 481B-1.6 presumes it by requiring that mailed prize offers explain how to enter without purchase. It comes with a doctrine called equal dignity, in three parts:

• Equal odds. One entry is one entry. Sections 5 and 7 lock this down.

• Equal ease. The free routes can't carry extra hoops, extra required information, or a shorter window. This is why the postmark deadline moved.

• Equal prominence. The one that trips people, and it lives outside this document. Wherever you promote that subscribers are entered, the free route appears right there with it—same size, same visibility, not a footnote.

A Tylenol sweepstakes drew a regulatory settlement for exactly the third failure: pushing purchase in the advertising and burying "no purchase necessary" in fine print. The rules page was fine. The ads weren't.

PASTE THIS EVERYWHERE THE GIVEAWAY AND THE SUBSCRIPTION APPEAR TOGETHER
No purchase necessary. US subscribers are entered automatically; anyone can enter free—see Official Rules at kellyvalencia.com/monthly-giveaway.

On mailed pieces Hawaiʻi requires more than that—the odds statement and a physical address for free entry. Use the longer mail insert block from the compliance package.

Two things to say out loud

Your international subscribers cannot win, and they will assume they can. Section 3 states it, but it belongs on the International Correspondence Edition product page in plain language: "The monthly artwork giveaway is limited to US residents by law, and isn't part of this edition." Better from you than from a rules page after a year of paying.

Don't sell the subscription on the giveaway. "Subscribe and be entered to win" frames the subscription as buying a chance. "Subscribers are entered automatically, and anyone can enter free" frames it as a perk. Same facts; only one invites the question.

Your cycle

Stage When Example—the September 2026 Giveaway
Entry Period opens 15th of the preceding month Saturday, August 15
Entry Period closes 14th Monday, September 14
Subscriber snapshot At close—payment received, not refunded End of day September 14
Mail-in postmark deadline 14th Postmarked by September 14
Mail-in receipt deadline 21st Received by Monday, September 21
Drawing On or about the 22nd Tuesday, September 22
Winner notified Within 3 business days By Friday, September 25
Response deadline 7 calendar days from first notice By Friday, October 2
Prize ships Following month's mailing cycle Early to mid October

The week between the postmark and receipt deadlines is deliberate. Mail from the mainland to Kauaʻi takes time, and a card postmarked on the 14th has to actually make it into the drawing or the free route isn't equal in practice. Hold the drawing if something is still visibly in transit.

What you do each month

Nothing in the rules. They are evergreen. Your entire monthly job is one block on the giveaway page, posted before the period opens on the 15th:

THE MONTHLY BLOCK
This month: the [August 15 – September 14] Giveaway. Prize: [one original 5×7 acrylic, "Lilikoʻi"]. Approximate retail value: [$150]. Drawing on or about [September 22].

Screenshot or PDF that block each month and file it. It is your record of what was announced, which is what matters for the prize-value thresholds and for anyone who later asks what the prize was. File it alongside the drawing screenshot and the tracking confirmation.

Standing decisions, and why

• Entries reset monthly. Keeps each month a separate promotion with one artwork as its prize, which keeps you below the $5,000 registration thresholds in New York and Florida. A perpetual pool feeding twelve drawings starts to look like one twelve-prize promotion.

• One prize per person and household per rolling twelve months. No law requires a repeat-winner limit, but entry and prize limits are a required element of Official Rules. It also makes two wins in one calendar year impossible, which quietly forecloses the 1099 aggregation question.

• Data deleted on a schedule. Non-winning free entries at 90 days. Winner records 12 months to administer the prize limit, longer where a 1099 issued. Subscriber account data stays under your normal subscription terms.

• $40–$500 band with a $1,999.99 absolute cap. Keeps you under the $2,000 tax threshold by default and nowhere near $5,000. Try to spread what you actually award across the band rather than clustering at the bottom.

• Tracking, not insurance. Priority Mail and Ground Advantage include $100 at no charge, so you have baseline coverage anyway. Tracking is the more important record—it's your proof you awarded the prize, which is what Hawaiʻi cares about.

THE ONE RULE ABOUT CHANGING THE RULES
Official Rules cannot be altered once an Entry Period has begun. Your period opens on the 15th of the preceding month, so any change must be published before that date—not before the 1st. Let the current period finish, publish the new version before the next 15th, and keep a dated copy of every version.

Prepared by Claude, an AI assistant, at Kelly Valencia-Aiken's request. General information, not legal advice; no attorney has reviewed it. Have a Hawaiʻi-licensed attorney read these rules before the first drawing, and confirm the entity and tax questions on the cover page with your CPA. Thresholds and IRS figures change.
